Since Myanmar’s 2021 military coup, many Burmese people inside Myanmar and abroad have supported the National Unity Government (NUG), People’s Defence Forces (PDFs), and other resistance groups. Support may include political advocacy, humanitarian assistance, fundraising, or direct donations.
For Burmese people later applying for a U.S. immigrant visa, green card, asylum, or another immigration benefit, this can create a very uncomfortable question:
If I donated money to the NUG or PDF, do I have to disclose it when the U.S. immigration form asks whether I supported a terrorist organization?
The answer requires some explanation.
Is the NUG a U.S.-designated terrorist organization?
The Myanmar military regime has designated the NUG, the Committee Representing Pyidaungsu Hluttaw (CRPH), and PDF groups as terrorist organizations under Myanmar law. The U.S. State Department itself has reported that these designations were made by Myanmar’s military regime.
That does not mean the United States has adopted Myanmar’s designation.
In fact, the U.S. government has publicly engaged with representatives of the NUG. In August 2024, senior U.S. officials met with NUG and other pro-democracy and resistance representatives and stated that the United States would continue supporting pro-democracy actors in Burma.
So it would be misleading to simply say:
“The United States considers the NUG a terrorist organization.”
That is not what the U.S. government sources say.
But this is where U.S. immigration law gets complicated
U.S. immigration law does not limit the term “terrorist organization” only to organizations formally placed on the State Department’s Foreign Terrorist Organization list.
The Immigration and Nationality Act recognizes several categories. One category can include an undesignated group of two or more people that engages in certain activities defined as terrorist activity under U.S. immigration law. These are sometimes called Tier III organizations.
That distinction matters enormously.
A group therefore does not necessarily need to appear on the official U.S. FTO list before someone’s involvement with it can raise Terrorism-Related Inadmissibility Grounds, commonly called TRIG.
What about the PDF?
This is even more complicated because “PDF” does not necessarily describe one single organization operating everywhere in Myanmar.
The U.S. State Department has documented both the armed conflict involving PDFs and allegations that some PDF groups or members committed abuses. It has also documented the NUG’s efforts to establish standards of conduct for PDFs.
Therefore, whether a particular organization, unit, activity, or donation creates an immigration issue can depend on what group was involved, what that group was doing, when the support occurred, what the applicant knew, and what exactly was provided.
What does the DS-260 actually ask?
The immigrant visa application does not merely ask:
“Have you donated to an organization on the U.S. terrorist list?”
The DS-260 asks applicants whether they have ever provided financial assistance or other support to terrorists or terrorist organizations, along with related terrorism questions. The State Department also warns applicants to provide complete and accurate information and explains that a Yes answer does not automatically mean a visa will be denied.
That means a Burmese applicant should not decide the answer solely by Googling whether “PDF” appears on the U.S. FTO list.
Can a donation count as “material support”?
Potentially, yes.
Under U.S. immigration law, “material support” can include things such as:
funds, transferring funds, transportation, communications, safe houses, documents, weapons, explosives, training, and other material assistance.
So a financial donation is not automatically outside the law simply because the amount was small.
There are circumstances in which discretionary exemptions may exist for certain limited support, humanitarian assistance, support under duress, or other qualifying situations. But these rules are complicated and highly fact-specific. USCIS guidance also emphasizes full disclosure of relevant support and associations when an exemption is being considered.
Example: “I donated $50 to help displaced families.”
That is very different from:
“I donated money specifically to purchase weapons for an armed unit.”
It may also be different from:
“I donated to an NUG-affiliated fundraiser but did not know exactly where the money went.”
Or:
“I regularly raised funds for a particular PDF battalion.”
Those facts matter.
The person’s intent, knowledge, recipient, purpose of the money, organization involved, and activities of that organization can all become relevant.
Should you simply answer “No” because you support democracy?
No.
Political sympathy for Myanmar’s democracy movement and the technical questions contained in U.S. immigration law are two different issues.
Likewise, an applicant should not answer “Yes” automatically merely because Myanmar’s military government calls the NUG or PDFs terrorists.
The correct answer has to be based on the actual U.S. immigration question and the applicant’s individual facts.
Do not hide the donation
This may be the most important point.
If an applicant has meaningful involvement, fundraising, donations, training, membership, or other support connected with an armed organization in Myanmar, trying to conceal it can create an additional immigration problem.
The DS-260 specifically requires complete and accurate answers, and USCIS policies addressing possible TRIG exemptions emphasize disclosure of relevant contacts, associations, and material support.
A person’s underlying activity might have an explanation or possibly qualify for an exception or exemption. A false statement on an immigration application can create an entirely separate problem.
What should a Burmese immigrant do before answering?
If your only connection was something straightforward such as publicly supporting democracy, that is different from providing assistance to an armed organization.
But if you:
- donated directly to a PDF or armed resistance unit,
- raised money for one,
- transferred money on behalf of one,
- purchased supplies or equipment,
- transported members or materials,
- received military training,
- were formally a member, or
- had substantial involvement with an armed resistance organization,
do not guess your way through the DS-260.
This is one of the situations where speaking with a U.S. immigration attorney familiar with TRIG/material-support cases before submitting the form can be worth the money.
Bottom line
Myanmar’s military regime labeling the NUG and PDFs “terrorist organizations” does not by itself make them U.S.-designated Foreign Terrorist Organizations.
But that also does not automatically mean every donation or activity involving a PDF is irrelevant to U.S. immigration law.
U.S. immigration law contains a much broader definition of terrorist organizations and material support than many applicants realize. Financial support can potentially fall within those provisions even when an organization has never appeared on the State Department’s formal FTO list.
For someone completing a DS-260, I would therefore never recommend automatically checking Yes or No based only on the words “NUG” or “PDF.” The exact recipient, purpose, conduct, amount, timing, and circumstances need to be examined.
